Please read these Terms of Service ("Terms") carefully before using the SnapPanda application ("the app"). By downloading or using the app, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using SnapPanda, you agree to these Terms. If you do not agree, do not use the app.

2. Description of Service

SnapPanda is a photo analysis application that evaluates photos across multiple dimensions including composition, lighting, sharpness, color harmony, and aesthetics. Every photo is analyzed using both on-device processing on your iPhone and Gemini-powered cloud AI for deeper feedback. Photos sent for Gemini analysis are not stored after processing.

3. Use of the App

You agree to use SnapPanda only for lawful purposes and in accordance with these Terms. You may not:

• Reverse engineer, decompile, or disassemble the app
• Attempt to extract the machine learning models or algorithms
• Use the app for any commercial purpose without prior written consent
• Redistribute or resell the app or any part of it

4. Intellectual Property

SnapPanda, including its design, code, machine learning models, and content, is the intellectual property of SnapPanda and is protected by applicable copyright and trademark laws.

5. Disclaimer of Warranties

SnapPanda is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the app will be error-free, uninterrupted, or that the scores and feedback will meet your expectations.

6. Limitation of Liability

To the maximum extent permitted by law, SnapPanda shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the app, including but not limited to loss of data or profits.

7. Updates and Changes

We may update the app or these Terms at any time. Continued use of the app after changes constitutes acceptance of the revised Terms. We recommend reviewing these Terms periodically.

8. Termination

We reserve the right to terminate or suspend your access to the app at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users or us.

9. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
